These Terms of Use (“Terms”) govern your use of the Not Bored website and progressive web application at notboredapp.com (the “Service”), operated by Why and How LLC, doing business as Not Bored in DC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

Account Responsibilities

When you create an account, you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or use automated means to access the Service without our permission
• Impersonate any person or entity
• Upload or transmit viruses, malware, or other harmful content
• Use the Service to harass, abuse, or harm others

Intellectual Property

The Service, including its design, text, graphics, logos, icons, images, and software, is the property of Why and How LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the Service without our prior written consent.

The “Not Bored” and “Not Bored in DC” names, logos, and related marks are trademarks of Why and How LLC.

Event Information

The Service aggregates and displays information about events in the Washington, DC area. We strive to provide accurate and up-to-date information, but we do not guarantee the accuracy, completeness, or reliability of any event information displayed. Event details including dates, times, locations, and pricing are subject to change by the event organizers without notice.

We are not the organizer of events listed on the Service unless explicitly stated. We are not responsible for the content, safety, or quality of third-party events.

Third-Party Links and Content

The Service may contain links to third-party websites, businesses, and services. We are not responsible for the content, privacy practices, or availability of these third-party sites. Links to third-party content do not constitute endorsement by us.

Premium Subscriptions

The Service may offer premium subscription plans that provide access to additional features. Subscriptions are processed through our payment provider, RevenueCat, using Stripe for payment processing.

• Subscriptions automatically renew unless canceled before the end of the current billing period
• You can manage or cancel your subscription from the Subscription page within the app, or by contacting us at privacy@notboredapp.com
• Refund requests can be submitted by contacting us at privacy@notboredapp.com and will be reviewed on a case-by-case basis
• Prices may change, but we will notify you in advance of any price increases

User Data

By using the Service, you may save events, mark cat crawl stops as visited, and interact with other features that store data associated with your account. You retain ownership of your personal data. We use this data only as described in our Privacy Policy.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHY AND HOW LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Why and How LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting us at privacy@notboredapp.com.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the District of Columbia.
